The royal decree approved this Tuesday by the Council of Ministers and published this Wednesday in the Official State Gazette (BOE) declaring the “situation of interest for national security in the city of Ceuta,” with a single command and crisis committee, which will initially be in effect until December 31, does not imply an assumption of the limited powers of the autonomous city by the central government. In other words, far from implying a kind of intervention, like that which would result from the application of article 155 of the Constitution, the Government maintains the constitutionally and statutorily established powers but assumes control of the management of the material and human resources necessary to resolve the crisis.

The preamble of the royal decree states that the single command falls to the Ministry of Territorial Policy led by Ángel Víctor Torres because it is the department responsible for executing policy regarding relations and cooperation with autonomous communities and entities that make up local administration, and the powers related to the territorial organization of the State.” But it is only attributed “the indispensable powers for the direction and coordination of actions,” that is, “the human and material resources necessary to face the situation.”
Although a total of eleven ministries will be involved in the crisis committee, each will be responsible for identifying “the specific resources” needed, “not only regarding the territory of the city, but in everything functionally necessary and linked to resolving the crisis.” But actions will be governed by, among other principles, “respect for the distribution of powers established constitutionally and statutorily.
The single command “will not alter the ownership of the powers of the intervening authorities nor the established organic relationships and chains of command”
Although the single command has defined functions, including directing and coordinating actions, defining “common” objectives, preserving essential services “jointly with the competent authorities,” and initiating “all necessary actions for the return of migrants,” its actions “will not alter the ownership of the powers of the intervening authorities nor the legally established organic relationships and chains of command,” states the royal decree.

In fact, given the phase in which the Ceuta crisis is, where the urgent matter is to begin the process of identifying the migrants wandering the streets and proceed with their return, both administrations – central government and Ceuta’s – contribute in the royal decree by mobilizing all available spaces to safely accommodate these immigrants and begin the identification and return process. In this way, both the Government, through its different ministries, and the Ceuta Executive make all sports centers and available grounds available.
Infrastructure provided by the central government and Ceuta
Specifically, the decree includes the following infrastructures dependent on the Government of the city of Ceuta: land provided in the ‘parking’ area of the bottleneck in Loma Colmenar, space corresponding to the Military Hospital, provided as state property to the city by the Ministry of Defense; covered sports centers of Santa Amelia, La Libertad, Antonio Campoamor, Guillermo Molina Sports Complex, and Díaz Flor Sports Complex. Within the city of Ceuta, within their respective powers, resources allocated to social and care services, protection and care of minors and other vulnerable persons, local police, civil protection, and fire prevention and extinction are included. It also maintains health services under its competence, supply, sanitation, and urban services; accommodation and facilities of its own ownership and other essential services whose continuity may be affected.
On the other hand, the central government specifically provides the following infrastructures in the city of Ceuta: land provided by the Ministry of Defense in Loma Margarita, in the Equestrian facilities, in the flour factory warehouse, in the old cavalry barracks football field; land of the Ministry of Ecological Transition of the Guano esplanade (old Guano factory), land not in use by the Ministry of Defense in the Colonel Fiscer Barracks, and the covered sports center of the Ministry of Education of the IES Puertas del Campo.
