The Supreme Court orders Atresmedia to cease broadcasting 'Pasapalabra' with El Rosco

Antena 3 will not be able to broadcast the famous Rosco from Pasapalabra. The Supreme Court has confirmed in a ruling issued on April 30, which was made public this morning, that El Rosco belongs to MC&F. The High Court confirms a previous ruling by the Provincial Court of Barcelona and thus puts an end to a long procedure.

“El Rosco constitutes a work protected by intellectual property, whose ownership corresponds to the company MC&F Broadcasting Production and Distribution C.”, the Supreme Court has determined against what Atresmedia, owner of the Antena 3 channel, which broadcasts the successful Pasapalabra program every Monday to Friday night before the 9:00 p.m. news, intended.

The Supreme Court judges consider that El Rosco, a game in which contestants have to guess a word after hearing the definition given by the host, is not a “simple idea” or mere game rule, but a protected television format. It is therefore an “original creation,” as it reflects the free and creative decisions of its authors, Mr. Pianta and Mr. Loeb, who gave it “a unique character that distinguishes it from other games based on the alphabet.”

Consequently, the ruling determines that the broadcast of the game by Antena 3 constitutes “an infringement of the intellectual property rights of MC&F.” The channel must “immediately cease any act of reproduction or public communication of the format.” In addition, it will have to withdraw and destroy “all recordings and production materials of the game,” as ordered by the ruling.
