The PSPV has filed an amparo appeal against the resolution of the Corts Valencianes that approved – with the votes in favor of PP and Vox – the final report of the commission investigating the dana and rejected the dissenting vote presented by the socialist group.
The party denounces in its appeal a violation of the fundamental right to exercise public representative office (article 23.2 of the Spanish Constitution), in connection with the right of citizens to participate in public affairs through their representatives (article 23.1 CE). A violation that, they point out, manifests itself in two issues.
The first, for replacing the direct appearance of key officials in the autonomous management of the emergency (such as the former Emergency Minister Salomé Pradas, the Deputy Director General of Emergencies Jorge Suárez) with the mere incorporation of the transcripts of their interventions before the Congress of Deputies commission, “depriving the appealing deputies of the ability to ask their own questions, follow up, request clarifications, confront the witnesses with the documentation gathered, and direct the interrogation towards the specific object of the investigation carried out by Les Corts Valencianes.”
The second, the socialists point out, for preventing or limiting “the exercise of the investigative and control function regarding actions and officials belonging to the Generalitat’s scope” and “shifting” in the conclusions the political oversight towards the General State Administration. In this regard, they recall that the control of the deputies of the Corts is limited to the autonomous scope.

The socialists request that “the possibility of carrying out the improperly prevented appearances and interrogations” be included
As explained by the socialist parliamentarian Alica Andújar, the appeal demands “that the violated rights be restored and that a parliamentary action that cannot have a place in an institution representing the voice of the Valencian people, and consequently, the memory of the 232 people who drowned, be annulled.”
Thus, the PSPV asks the Constitutional Court to declare the nullity of Resolution 406/XI of the Corts Valencianes and to revert the actions to the moment prior to the violation so that the parliamentary investigation can continue, “including the possibility of carrying out the improperly prevented appearances and interrogations.”
“We will go all the way and use all legal and parliamentary means at our disposal to ensure that this report is nullified and removed from the Journal of Sessions of the Corts,” Andújar stated.
