The State Attorney’s Office has requested the judge of the National Court María Tardón to accept its appearance as an injured party due to the massive entry of migrants from Morocco to Ceuta on July 30 and 31. In a document accessed by La Vanguardia, the State’s legal services argue that the facts under investigation “would clearly affect state safeguarding and national security.”

For this reason, the head of the criminal area of the Attorney’s Office considers that “it is undeniable that the legal assets susceptible to protection, indicatively, would be, among others, national sovereignty, the independence and stability of the State, its territorial integrity, national defense, external security, and the stability of the Rule of Law,” as stated in the very order admitting the complaints filed.
All these legal assets are, according to the lawyer, institutional and “whose ownership unquestionably corresponds to the State itself.”
The document emphasizes the legal classification of the facts investigated, proposed by Tardón, concluding that these facts correspond to “a complex, organized, and clearly supraterritorial phenomenon.”
The investigating judge already pointed out that these facts require a unified jurisdictional response “that can be classified, (among others) as crimes that compromise the peace or independence of the State and that may affect public order and the deterioration of public security, and may even have caused an impact on the health system, among other legal assets that may have been affected.”

The judicial order also adds that the behaviors subject to the procedure have constituted an “attack, a violation of the territorial integrity of Spain,” without ignoring the use of migratory flows to destabilize National Security.”
Furthermore, it cannot be overlooked – according to the document – that if this indicative analysis is confirmed, “undeniable economic damages would also have been caused by the analyzed facts, partly funded, without a doubt, by the General State Administration.”
On the other hand, Judge Tardón has already admitted the appearance of the Government of Ceuta, which had also appeared as an injured party. In her order, the magistrate states that “in this case, the status of injured party undoubtedly applies, due to the serious facts that have had the City of Ceuta and its inhabitants as direct and immediate victims, in their freedom, the exercise of their rights, and the integrity of their persons and property.”
