The Prosecutor’s Office asks Judge Tardón to investigate the mass entry of migrants in Ceuta

The Public Prosecutor’s Office has requested the judge of the National Court María Tardón to investigate the massive entry of nearly 80,000 people into Ceuta from Morocco on July 30 and 31.

The public ministry considers that the Court is competent to investigate facts that could constitute a crime of facilitating irregular immigration, aggravated by the possible commission within an organization and by endangering the life or physical integrity of the affected persons. In addition, there are indications of the commission of crimes of homicide and injuries due to serious negligence by an organization or criminal group.

Likewise, the chief prosecutor of the National Court, Jesús Alonso, points out that the investigation must determine whether the facts could constitute crimes affecting public order or legal goods of a collective nature such as peace or the independence of the State.

The Public Prosecutor’s Office informs the magistrate that in its opinion the National Court is indeed competent to investigate the events that occurred in Ceuta, as well as considering that there are indications of a crime to initiate an investigation, as several accusations have requested in separate complaints.

“According to the indications contained in the proceedings, a substantial part of the planning phase, mobilization, logistical coordination, digital dissemination, and eventual strategic direction would have taken place in Moroccan territory, while the material execution of the action, the pursued result, and the most relevant effects occurred in Spanish territory,” so the competence to investigate lies with the National Court.

Before ruling on competence and admission of the complaints, the magistrate requested reports from the National Police and Civil Guard about what happened, possible perpetrators, the possible existence of criminal organizations behind what happened, and the existence of alerts in the previous days.

The Police report hinted at possible complicity of the Moroccan government, while the Civil Guard attributed what happened to massive campaigns through social networks.
