The attorney general asks prosecutors to act if a community refuses to host minors

The State Attorney General, Teresa Peramato, has instructed the delegated prosecutors of the autonomous communities to intervene if an autonomy refuses to accommodate unaccompanied migrant minors from Ceuta who are referred to their protection system.

Through an instruction issued this Friday, the Prosecutor’s Office has established a series of guidelines for the protection of the best interests of unaccompanied children and adolescents.

This decree comes amid the debate over the management of children and adolescents who arrived alone in Ceuta during the massive entry on July 30 and 31 – the exact number is unknown but the Police have collected data on 1,342 – and their future referral to other communities according to the current relocation model, which is opposed by the communities governed by PP and Vox.

Within this procedure, created in March 2025 to relieve the autonomies with greater migratory pressure such as the Canary Islands or Ceuta, the State Attorney General’s Office has reminded that, from the moment the minors’ section of the destination place becomes aware that a transfer will be made, the necessary measures must be taken to ensure the proper reception, care, and protection of the young people.

And it emphasizes that the competent prosecutor must exercise “superior oversight and control” of these measures.

The Public Ministry has reminded that if an autonomy rejects or shows reluctance to immediately assume the reception of these minors, the delegated prosecutor of the place of origin must inform their counterpart in the destination place.

Specifically, they must send a copy of the relocation and transfer resolution, as well as the allegations of rejection or delay of its execution.

Once this information is received, the prosecutor of the destination place will proceed to require the public entity responsible for the protection of minors in the receiving autonomous community to, “urgently,” designate the most suitable resource for the proper protection of the minors who will arrive in their territory.

This must be reported to the Minors Section, so that it can carry out control and supervision tasks, and to the competent department of the destination regional government, prior to the transfer date, as well as to the delegated prosecutor of the place from which the minor comes.

And this representative of the Public Ministry in the reception place must include in the requirement the warning contained in the royal decree of July 2025 that regulates the referral system – “All this, without prejudice to any possible liabilities that may be deduced” – and, if applicable, exercise the corresponding actions.
