The five members of the electoral board of October 1, 2017; Tània Verge, former ERC minister; lawyer Marc Marsal; Josep Pagès, current Junts deputy; Political Science professor Jordi Matas, and lawyer Marta Alsina have been amnestied.

The five had been acquitted by a Barcelona court, but the Barcelona High Court ordered a retrial. In the meantime, the amnesty law was approved, but it was not applied to them due to several jurisdictional disputes between judicial bodies. Now, as confirmed by ACN, they have been amnestied with the favorable opinion of the public prosecutor’s office.
The lawyers for the trustees requested that the amnesty be applied to them from the very day it came into force, but the judge handling their case submitted a reasoned statement to the High Court of Justice of Catalonia (TSJC) because Verge was an ERC deputy, and therefore privileged in the high Catalan court, which rejected jurisdiction and asked the judge to better specify the charges. In the end, Verge resigned as a deputy and the current judge unblocked the amnesty request for the five.

The electoral trustees were tried and acquitted in April 2021 by another magistrate in Barcelona’s criminal court number 11. The High Court ordered a retrial, as requested by the public prosecutor’s office, which sought two years and nine months in prison for the crimes of disobedience and usurpation of public functions.
The case remained stalled at this point, even though the amnesty law has been in force since June 2024.
