The Public Prosecutor’s Office of the Court of Accounts has once again requested this Tuesday, as it did in 2024, that the Amnesty Law be applied to the thirty former senior officials of the Govern who are being claimed for the expenses of 1-O and the foreign action of the Generalitat during the years of the procés. Among them are former presidents Carles Puigdemont and Artur Mas, as well as several former ministers. In addition, it reprimands the court for not applying the law directly.
In a letter, one day after the Second Prosecution Department lifted the suspension of the process and opened a ten-day period for the parties to submit allegations, the public prosecutor criticizes the supervisory body for having opened this period and for not having directly applied the criminal oblivion.
Furthermore, the chief prosecutor, Manuel Martín-Granizo Santamaría, considers yesterday’s transfer “improper and unnecessary” after the ruling of the Court of Justice of the European Union (TJUE) that endorses criminal oblivion.
“It is unnecessary because both the TJUE ruling in its first conclusion when it speaks of funds that do not come from the Union budget and the Advocate General’s report in section 62 when it says that the referral order does not contain any element indicating that funds from the Union budget or administered by the Union were used, rule out that community funds have been used.”

The prosecutor adds that the order in which the preliminary question was raised “did not contain any element that could support the misuse of community funds.”
The Court of Accounts avoided applying the amnesty from the outset and yesterday opened a ten-day period for the parties to present their allegations and provide documentation to prove the origin of the funds that were allocated to the expenses of the procés after the Luxembourg ruling, which stated that “acts subject to the procedure that refer to funds not originating from the European Union budget or intended for it” could be amnestied. The ruling, as the chief prosecutor has emphasized, also clarified that there was no impact on the financial interests of the Union.
In the case, beyond Mas and Puigdemont, several former ministers are implicated, such as Oriol Junqueras, who is president of Esquerra, Jordi Turull, secretary general of Junts, Raül Romeva, Toni Comín or Lluís Puig, among others.
