The latest victim recognized by the judicial authority is an elderly man who died from an acute myocardial infarction at his home in Benetússer on the night of the same day as the flash flood.
The instructor issued this resolution after the Public Prosecutor’s Office issued a report considering the inclusion of this death in the investigation appropriate.

According to the order, the forensic medical report indicated that it could not establish a causal link between the death and the circumstances experienced by this man on October 29, 2024, although it could be considered as “a contributing cause contemporaneous to the episode of acute stress suffered.”

“Stressful circumstances of such magnitude as those that occurred in the DANA, stemming from a previous pathological state, resulted in the death,” the magistrate notes, “due to an acute myocardial infarction on October 29, 2024, given the situation he was experiencing and witnessing from his home.”
The instructor therefore nullifies the dismissal previously agreed upon in other prior proceedings related to this death to join them to the case investigating alleged crimes of homicide and injuries by negligence.
