The judge in the Plus Ultra case, José Luis Calama, has rejected the nullity incident raised by former Prime Minister José Luis Rodríguez Zapatero, understanding that his rights were not violated.

The judge, in an order that does not admit appeal, thus settles the former Prime Minister’s attempt to annul the investigation against him for allegedly leading a network of influence peddling in favor of the airline Plus Ultra.
Calama, who initially had dismissed the document for being submitted late, later rectified and agreed to study some of the allegations, but, according to the prosecutor’s criteria, has decided to reject them.
The magistrate rejects the arguments given by Zapatero’s defense to claim nullity and denies, for example, that the police analysis of the conversations of a lawyer, which triggered this investigation, was an unauthorized interference in the secrecy of communications and the privacy of the investigated lawyer.
The former Prime Minister’s defense considered that this evidence should be annulled and thus give rise to a chain of nullities affecting the entire case, but the magistrate denies this, pointing out that the Police analyzed data “previously obtained with the authorization of a French court and the cooperation of a Spanish court.”

The magistrate also rejects that the Prosecutor’s Office conducted a parallel investigation, outside the examining judge, or that it overlapped, and endorses the way this procedure was initiated through a separate piece which, according to the judge, is connected to the main one and whose opening “does not require that the facts come exclusively from the main case.”
“The procedural action followed was in accordance with legal logic and did not affect the fundamental right invoked,” the magistrate also states to defend that the right to the judge predetermined by law was not violated, since Zapatero questioned that the Prosecutor’s complaint had not been subjected to distribution.
The judge thus ends the nullity incident presented by Zapatero and continues with the Plus Ultra investigation, in which the former Prime Minister is investigated for allegedly leading a network of influence in favor of the airline Plus Ultra and other companies.
