The United States Department of Justice has secured a second indictment against former FBI Director James Comey, this time for an Instagram post that was criticized by allies of President Donald Trump, media reported this Tuesday.

The specific charges filed by the Trump Administration against Comey, who already won an appeal to dismiss a first DOJ case against him, are not yet known, but they are believed to be related to an Instagram post from May 2025 that could be interpreted as a threat against Trump, Fox News reported.

The then-Secretary of the Department of Homeland Security, Kristi Noem, announced at the time the opening of an investigation against the former head of the Federal Bureau of Investigation for a photograph of shells forming the number “8647” with the message: “Curious shell formation during my beach walk.”
Trump’s followers interpreted the post as a political message directed at the Republican, who is the 47th president.
The number 86, in slang, can mean “to eliminate” or “to get rid of” someone, according to the Merriam-Webster dictionary.
In September 2025, Comey was indicted for alleged false statements to Congress and obstruction of a legislative proceeding, in connection with the investigation he led into the alleged ties of Trump’s 2016 election campaign with Russia.

Last November, a federal court dismissed the case against the former FBI director, along with that of New York Attorney General Letitia James, also indicted by the DOJ, after concluding that the federal prosecutor chosen by the president to lead the two proceedings was illegally appointed.
Comey, who became a sworn enemy of the US president, had already warned that it was very likely he would try to prosecute him again. “Donald Trump will probably come for me again,” he said in a video posted on his Instagram account.
James Comey, a Republican who had been appointed by former President Barack Obama (2009-2013), was fired by Trump after he first came to power in 2017.
His dismissal was highly controversial because at that time Comey was leading the investigation into the so-called “Russia plot” in the elections won by Trump in 2016.
