The magistrate has discovered new facts as a result of the investigation opened into the so-called “plumber” of the PSOE, Leire Díez, who was arrested in December in an operation on the alleged collection of kickbacks, according to legal sources.

However, from the analysis of the seized documentation new data have appeared, which has prompted Pedraz to order the central operative unit (UCO) of the Civil Guard to go to the PSOE headquarters to request various documentation and electronic files in an investigation against “a plot aimed at destabilizing judicial procedures affecting the PSOE or the Government.”

The judge directs the procedure against the former Secretary of Organization of the PSOE Santos Cerdán, the former socialist member Leire Diez, the businessman Javier Pérez Dolset, the former Minister of the Presidency of the Junta de Andalucía Gaspar Zarrías and the lawyer Ismael Oliver for crimes of criminal organization, multiple bribery offenses, disclosure of secrets, inducement to false testimony, false accusation, falsification of commercial documents, malfeasance, influence peddling and crimes against the institutions of the State.

He also investigates the lawyer Jacobo Teijelo – who defends Cerdán – and the civil guard Juan Sánchez Yepes for crimes of disclosure of secrets, bribery and against the institutions of the State.

“Deceptive invoices”

Likewise, the instructor sees indications of criminal liability of the manager of the Secretariat of Organization of the PSOE Ana María Fuentes, at least as an accomplice and, in any case, as the author of the possible crime of falsification of commercial documents for the issuance of “deceptive invoices.”

Regarding the president of Correos Juan Manuel Serrano Quintana and the socialist deputy Juan Francisco Serrano Martínez – a man close to Cerdán -, the magistrate points out that there are indications revealing their collaboration with the investigated parties “in the execution of specific and isolated acts in aid of their illicit plan.” However, he considers that it will be necessary to wait for the development of the investigation to specify their criminal liability.

The magistrate argues that the allegedly criminal activity investigated is serious both because of the penalties that could be imposed, and because of the high amount of the economic transactions under investigation, so he considers the agreed requests proportionate.

These measures are specified in requests to natural and legal persons, as well as to public and private entities to immediately deliver all the documentation, electronic files and information detailed in the three orders that have been notified this morning to the legal representatives of those required.
