The president of Esquerra Republicana, Oriol Junqueras, has celebrated the endorsement of the Court of Justice of the European Union (CJEU) for the Amnesty law. In the words of the republican leader, it is a “great political victory for the independence movement and democrats.” After the European court’s ruling, Junqueras called on the Spanish courts to apply the law “without further delay”: “There are no more excuses. Rights must be restored, exiles must return, and it is necessary for the State to close this chapter after almost 10 years.”

The Court of Justice of the European Union (CJEU) has endorsed this Thursday the Amnesty law approved by the Congress in 2024 in response to the preliminary questions raised about criminal oblivion by both the Court of Auditors and the National Court, regarding the possibility of amnestying embezzlement crimes, on the one hand, and terrorism, on the other. The CJEU must indicate whether the rule approved by the Congress in 2024 is compatible with the EU legal framework.

The Court of Justice of the European Union (CJEU) endorses the amnesty law by considering that it does not affect European interests nor is it contrary to the European directive on terrorism. This was announced in the reading of the ruling of a judgment that comes a year and a half after the Court of Auditors and the National Court submitted the preliminary questions to the court based in Luxembourg.
