After opening an ex officio investigation into what happened, Marlaska stated in the Government control session in Congress, in response to Junts deputy Marta Madrenas, that from that “reserved information” it has moved to the opening of a file to assess whether the action constitutes a serious or very serious offense.
A decision made after considering that the police action is “in no way justified,” regardless of the fact that the person was carrying an “absolutely legitimate” symbol such as the senyera estelada.

The investigated events took place on August 23 following a video circulated on social media showing how National Police officers strike a young man after taking an estelada from him. The young man confronts the police, and they end up hitting him on the ground.
